Following the prosecution and sentencing of Delico Ltd at Aylesbury Crown Court for an employee’s death at the workplace, the Health and Safety Executive (HSE) has advised companies to ensure that their risk assessments include tasks like routine maintenance and cleaning of equipment.
The HSE’s advice came after the court ordered Delico to pay a fine of 160,000 pounds and deposit another 40,452 pounds as costs. The court’s ruling came after the company pleaded guilty to the charges of negligence in maintaining safety at the workplace under section 2(1) of the Health and Safety at Work Act, 1974, at an earlier hearing.
The HSE’s investigation into the incident found that Lynda Trebilcock, a cleaner at Delico’s meat processing plant at Snelshall West, Milton Keynes, was cleaning a blending machine when its door suddenly slammed on her head. She suffered serious head wounds and succumbed to her injuries on the spot.
Following the prosecution, the HSE Inspector Karl Howes said that it is the duty of employers to make sure that all the equipments are safe for workers. Assessment of risks is also important, including those associated with maintenance and cleaning of machinery, so that such accidents do not take place again.

Courts and their judgments are generally respected and accepted unconditionally. Unfortunately, one such judgment has come under the scanner for its unrealistic nature. Not only this, the Chartered Institute of Personnel and Development has already sounded the warning of possible misuse of this particular judgment.
It is regarding the issue of extra sick leaves in case an employee falls sick while on vacation. The court has ruled in favour of the employee saying that a worker is entitled to be sanctioned the days he stays ill while holidaying as extra holidays at a later date.
Some people are claiming that the lawyers may consider such judgement theoretically correct, but it is not possible to implement it in the true spirit. The employers have two genuine concerns against this move. Firstly, they will have no way to stop dishonest employees from feigning sickness during leave and then demanding extra holidays as compensation. Secondly, even if the employee is true about his sickness, the employer ends up giving more holidays and losing financially.
Ben Willmott, a senior adviser at the CIPD, mentioned that the institute fears this will prompt the employers to tighten their belts and start reviewing their sick pay schemes, which are now quite liberal and flexible. Most of them will shift to a Statutory Pay scheme and this will actually harm the employees.
This is the classic example of a well-intentioned ruling harming the intended beneficiary simply because it has not taken into consideration the ground realities. Falling sick while holidaying can at best be described as bad luck, and the employers should not be forced to compensate for it. Again, even a genuinely sick employee will have to make special efforts to prove that he is sick.
